Criminal Law

Representation of suspects, defendants and victims at every stage of investigation and trial.

Criminal law governs acts of individuals or legal entities that harm public order, the rules set by the state or the rights of others. It sets the limits within which the state may exercise its power to punish, and by defining offences and their consequences it protects both public order and individual rights.

Criminal proceedings are among the processes that most directly affect a person's fundamental rights and freedoms. Every step of the investigation and prosecution must comply with procedure to safeguard the right to a fair trial, which makes professional legal support indispensable for victims and defendants alike.

Boybey Law & Consultancy is committed to protecting its clients' rights at every stage of criminal proceedings, including custody, arrest, statements, defence, hearings and appeals. We also act for victims and provide advice on criminal complaints, reconciliation and the enforcement of sentences, handling every file with diligence, confidentiality and fairness.

Frequently asked questions

Do I have the right to a lawyer in custody?

Yes. A suspect may benefit from the assistance of one or more defence lawyers at every stage of the investigation. If they cannot appoint one, a lawyer is assigned by the bar association on request.

How long do I have to file a complaint?

For offences prosecuted only upon complaint, the complaint must be made within six months of learning of the act and the offender. A complaint made after this period has no effect.

What is victim-offender reconciliation?

Reconciliation allows the suspect and the victim to reach an agreement through a conciliator for certain offences listed in the law. If reconciliation is reached and its terms are fulfilled, a decision not to prosecute may be issued.
